Let’s be clear! The 14th Amendment to the United States Constitution states “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States…” An executive order by Trump can’t change this rule. PERIOD!
Crystal Williams, Executive Director of the American Immigration Lawyers Association could not have been more accurate when she said “Birthright Citizenship is as American as apple pie – that each person is born equal with no disadvantage or exalted status arising from the circumstance of their parentage.…”
No executive order by this President can erase the Constitutional guarantee to citizenship. It doesn’t matter what’s the immigration status (documented or not) of the parent(s) of a child born in the United States – that child is an American Citizen.
Furthermore, because the rules of citizenship acquired by birth within the United States is the Law of the Constitution, not even legislation can change it. The only thing that can change this is an amendment to the United States Constitution.
Children born in the United States automatically become citizens of the United States.
